Employment Tribunal compensation limits will increase on 1 February 2013 under the Employment Rights (Increase of Limits) Order 2012.
- The maximum compensatory award for unfair dismissal will rise from £72,300 to £74,200.
- The maximum amount of a week’s pay, used to calculate statutory redundancy pay (among other things) will rise from £430 to £450.
- The maximum basic award (and statutory redundancy pay) will increase from £12,900 to £13,500.
This now means that the maximum unfair dismissal award can be £87,700 (maximum basic award plus maximum compensatory award).
The new limits are applicable where the event that gives rise to the award or payment occurs on or after 1 February 2013.
There is still no limit to the amount that can be awarded for unfair dismissal for certain health and safety and whistleblowing reasons. Furthermore, there is no limit to the amount that can be awarded for discrimination claims.
